Terms of Participation

1. Preamble

1. The Company, A. Zorpas & Sons LTD, being the exclusive and legal masterfranchisee of Coffee Berry in Cyprus with registered office and head office at 51 Armenias Street, 2006 Strovolos, Nicosia, Cyprus, as legally represented (hereinafter referred to as the “Organiser”), announces the launch of a competition entitled “The athletic spirit is in our DNA”, which will be conducted through the website https://coffeeberry.coffee/athletic-spirit-dna-cy/ (hereinafter the “Promotion”).

The Private Company under the name “Business Way IKE”, based in Ilioupoli, Attica (hereinafter the “Partner”) undertakes the technical implementation of the Promotion on behalf of the Organiser.

2. Description of Promotion

Visitors of the webiste with the brand name Coffee Berry at https://coffeeberry.coffee/athletic-spirit-dna-cy/ are invited to participate in the Promotion by scanning the QR code that will be displayed on the cups provided in stores, referring consumers to the designated page of the competition. On the landing page, visitors are asked to fill in their personal information: full name, email address, telephone number and choice of t-shirt based on category (Female, Male, Children’s) to participate in the drawing.

3. Eligibility & Exclusion of Participants

The right to register for the Promotion is open to those who reside permanently in Cyprus and are over 18 years old. Those who fall under the following circumstances are excluded from the Promotion: (a) The employees of the company of the Organiser and the Technical Contractor. Any participation of the above persons in the Promotion in violation of this term shall be automatically void.

4. Duration of the Promotion

The duration of the Promotion will commence from July 24, 2024, at 8:00 a.m., until September 1, 2024, at 9:00 p.m.

5. Prizes

Thirty (30) authentic t-shirt of the biggest celebration of sports – Paris 2024.

6. Nomination of winners

Among the participants in the Promotion who successfully completed the steps set out in paragraphs 2 and 3, thirty (30) winners and twenty (20) runners-up will be selected through the electronic drawing process. The relevant drawing will take place on September 6, 2024 at 10:00 at the offices of the Οrganiser. The winners will be informed by phone about the process of receiving the prize. Winners must respond within five (5) calendar days to accept the prize and chose from which store they wish to receive it.

 

In case the Organiser does not receive a response within the period specified above, the runner-up will be informed.

Winners will receive the prize from the nearest Zorpas Bakery or Coffee Berry store.

Winners will be posted on https://coffeeberry.coffee/athletic-spirit-dna-cy/ for 15 days.

7. Personal data

Information regarding the collection and processing of your personal data, as well as the exercise of your rights that derive from the legislation with reference to personal data may be found in the Privacy Policy (term 11) below.

8. Organisers Liability

The Organiser will not be liable for any reason for non-receipt of the Prize by the winner within the specified deadline. In the event that any of the above deadlines expires without action, the Organiser may or may not dispose of the Prize at her discretion, but having fulfilled her obligations towards the participants. In the event that for any reason the winner either does not respond or does not comply with any of these terms, the right to receive ceases to exist, as it is agreed that he/she has waived it. The Organiser bears no responsibility whatsoever if, for reasons beyond her control, such as – but not limited to – force majeure, technical problems, non-coverage or overload or network interruption, the sending and/or receipt of the response to the Promotion is delayed or fails.

9. PromotionIntellectual Property Rights

The Organiser reserves the right to advertise any event related to the Promotion, indicating the receipt of the Prizes.

10. Withdrawal of Notice – Amendment of Terms

The Organiser reserves the right to revoke the announcement of the Promotion, or unilaterally change at her sole discretion the terms of the Promotion, shorten or extend its duration, change the Prizes, cancel or postpone the Promotion with prior announcement on the Promotion’s website and via social media, with effective date of the revocation / amendment being the date of the relevant update.

11. Acceptance of the terms of the Promotion – Presumption – Applicable law – Jurisdiction

By participating in the Promotion, it is presumed that each participant has read these terms of participation, as well as the following Privacy Policy (the “Privacy Policy”) – https://www.zorbas.com.cy/politiki-aporritoy/ – is aware of them and fully accepts them. Participation in the Promotion requires unconditional acceptance of all the terms provided herein, as well as the Privacy Policy and entails a waiver of any relevant claim or demand against the Organiser. These Terms and the Privacy Policy are governed by the laws of Cyprus and the competent Cyprus Courts shall have exclusive jurisdiction with respect to any matter relating thereto.

12. Privacy Policy

The Organiser understands that the security of your personal data is extremely important and is committed to the respect of your privacy and to ensure the security and integrity of your personal data. This Privacy Policy presents how the Organiser uses your personal data, as well as the measures it has taken to protect and maintain such data. This Privacy Policy concerns the personal data we collect during your participation in the Promotion, as well as if you interact in any other way with us, including contacting us through social media.

Who processes my personal data?

Any personal data you provide to us during your participation in the Promotion is processed by the Technical Contractor, in its capacity as processor in the name and on behalf of the Organiser. Technical Contractors include the Technical Contractors of Coffee Berry Greece.

As far as winners are concerned, their personal data will be disclosed to the Organiser and the Partner.

What personal data do we collect?

We collect and save certain personal data solely for the purposes of your participation in the Promotion, as well as for the purposes of commercial communication, commercial promotion and advertising of the Organiser’s products via email and/or any other appropriate communication channels. The personal data we collect, use and save include:

· Your full name, e-mail address and telephone number, which you provide to us when registering for the Promotion through the special registration form.

· Technical information, including Internet Protocol (IP) address, used to connect your computer to the internet or connection information, browser type and version, time zone setting, browser types and versions, operating system and platform.

· Details of any additional questions or queries you may have about the Promotion that you submit via our Facebook , Instagram or email address marketing@zorbas.com.cy.

Personal data concerning you is provided directly by you.

Legal bases for processing

We process personal data concerning you solely for the purpose of:

  • To enable your participation in the Promotion.
  • Prevent, detect and investigate fraud, abuse or other illegal activities and potential violations of the Promotion Terms. We may access and use certain information for fraud prevention, as required by applicable laws and regulations and best practices, at any time. If false or inaccurate information is provided and fraud is detected or suspected, details may be passed on to fraud prevention agencies and other organisations and may be recorded by us or them.
  • To exercise our legal rights and comply with any legal obligation we have, such as, for example, to answer questions from public and administrative authorities including courts, police authorities, regulatory authorities, which may be legally able to access your personal data.

Publication of your information

Coffee Berry uses the services of the Technical Contractor and the Partner, who in their capacity as processors have undertaken the conduct of the Promotion on our behalf. The Technical Contractor and the Partner have also made contractual commitments and provide sufficient assurances for the implementation of appropriate technical and organizational measures in such a way that the processing of personal data meets the requirements of their respective Legislation. The processing takes place following recorded orders of the Organiser, in accordance with this Privacy Policy, as well as with all applicable laws on personal data protection.

How long will your personal data be saved?

The personal data we hold about you will be retained for three (3) weeks after the end of the competition in order to provide you with the requested products, services or information or for any other purpose as set out in the section titled “What personal data do we collect” above.

Transfers of personal data outside the European Economic Area (“EEA”)

Your personal data may be transferred outside the EEA or may be accessed outside the EEA for the purposes of the Promotion. Where we transfer data to (or allow access to) data from outside the EEA, we will ensure that your rights and freedoms regarding the processing of your personal data are properly and appropriately protected. To the extent that it is our obligation, we will ensure that all transfers of personal data outside the EEA are made on a valid lawful basis. This may include, for example, the use of personal data transfer agreements based on standard contractual clauses approved by the European Commission, or other appropriate legal mechanisms.

What do we do to protect personal data?

We will take all reasonable steps to ensure that your personal data is treated securely and in accordance with this Privacy Policy. All information you provide to us is stored on our secure servers. Unfortunately, the transmission of information over the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted to our websites – any transfer is at your own risk. Once we receive your information, we will use strict procedures and security features to try to prevent any unauthorized access.

What happens to links to other websites?

Our websites and related consumer pages on social media (social media fan pages) may from time to time contain links to and from the websites of our partners, subsidiaries and other third parties. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we assume that neither liability nor obligation arises for these policies. Your rights

During your interactions with us you reserve the right to ask us to:

• provide more details on how we use and process your personal data;

• provide a copy of the personal data we hold about you;

• correct any inaccuracies in personal data and complete any inadequate personal data we process about you;

• delete personal data, which we no longer have a reason to process; and

• limit the way we process your personal data while we conduct an investigation based on a question you have posed.

• withdraw your consent, where processing is based on consent;

• ask us to transmit the personal data you have provided to us and that we still hold about you to a third party electronically;

These rights are subject to certain exceptions to protect the public interest (e.g. prevention or detection of crime) and for reasons specifically introduced by the General Data Protection Regulation (EU) 2016/679.
